THE OPERATIONS REVIEW - Terms and Conditions

1. The Service The Operations Review is a paid consulting engagement delivered by Tomato Automate. Upon purchase, the client receives a 60-minute working session with a Lean Operations Expert and four custom deliverables — a Current State Assessment, SOP Blueprint, Automation Analysis, and Business Transformation Report — delivered within 48 hours of the session.
2. Payment The Operations Review is priced at $249 USD, payable in full at the time of booking. Payment is processed securely through Stripe. By completing payment, you confirm you have read and agree to these terms.
3. The $249 Credit If you choose to proceed with a Tomato Automate engagement following your Operations Review, the $249 fee is credited in full toward your project fee. This credit applies to new engagements only, is non-transferable, and has no cash value. The credit must be applied within 90 days of your Operations Review session date.
4. Intake Form Submission To receive the full benefit of your session, you are required to complete and submit the Operations Review Intake Form at least 72 hours before your scheduled session. Tomato Automate cannot guarantee the same depth of deliverables for sessions where the intake form is submitted late or incomplete. Late submission may result in rescheduling at Tomato Automate's discretion.
5. Rescheduling & Cancellation You may reschedule your session up to 24 hours before the scheduled time at no charge. Cancellations made more than 72 hours before the session are eligible for a full refund. Cancellations made within 24 hours of the session or no-shows are non-refundable. Tomato Automate reserves the right to reschedule in the event of unforeseen circumstances and will provide at least 24 hours notice where possible.
6. Deliverable Timeline All four deliverables will be delivered within 48 hours of the session. This timeline assumes the intake form was submitted on time and the session took place as scheduled. Tomato Automate will notify you if any delay is anticipated.
7. Confidentiality All information shared by the client during the intake process and session is treated as confidential. Tomato Automate will not share, sell, or disclose client business information to any third party without explicit written consent, except where required by law. A formal NDA is available upon request.
8. Intellectual Property All four deliverable documents produced as part of the Operations Review are owned by the client upon delivery and full payment. Tomato Automate retains the right to use anonymised, non-identifying findings for internal training and methodology improvement purposes only.
9. No Guarantee of Outcomes The Operations Review provides analysis, recommendations, and documentation based on information provided by the client. Tomato Automate does not guarantee specific business outcomes, revenue increases, or operational improvements as a result of the review. Results depend on the client's implementation of recommendations.
10. Limitation of Liability Tomato Automate's liability in connection with the Operations Review is limited to the amount paid for the service ($249). Tomato Automate is not liable for indirect, consequential, or incidental damages arising from the use of or reliance on the deliverables.
11. Governing Law These terms are governed by the laws of the State of New York. Any disputes arising from this agreement shall be resolved in the courts of New York.
